Assignment #1: Written papers need to be e-mailed to me (laruzow@citlink.net) by 5:00 p.m. on Friday, June 8, 2007. Acceptable formats are WORD, WORDPERFECT or PDF.

You are the top administrator (Principal) at a school in the Navajo Nation which is subject to the Fundamental Law of the Diné. A new non-Navajo administrator is starting work at the school in August as head teacher. The administrator is experienced, but has never worked for a school in the Navajo Nation before and has never worked at a school with a significant number of Navajo students or staff.

In 3-4 pages, please explain what the "Fundamental Law" is; why it is important and with respect to ONE of the following types of relationships, how the Fundamental Law informs such relationships:

a) Staff--Community/Parents
b) Staff-Students
c) Staff--School Board
d) Staff-Staff

A. Assume the NPEA Applies to your school and you are school principal: 

         Support Services Director Sheeno Nothing, whom you supervise, is a constant source of problems at your school. Sheeno Nothing has a two year contract with the school that will not expire until June 30, 2009.
         Ms. Nothing's reports (required by applicable law) are late, incomplete and have resulted in notes and exceptions during the last two school audits. She treats the staff under her direction with discourtesy.
         The School Board has expressed its concern about this situation and believes it has grounds for termination, but after several cases in which the school has been sued under the NPEA is concerned about terminating Ms. Nothing and then having to face an ONLR Charge and Labor Commission Complaint.
         Prepare a memo to the School Board advising them of what the NPEA requires with respect to terminating an employee like Ms. Nothing and what needs to take place to successfully terminate Ms. Nothing.

B. Assume the NPEA applies to your school and you are school principal. 

    The Board has approved the creation of a "Parent Liaison" position to provide outreach from the school to the community. Prepare a Position Description for this position. You can create such a Position Description in which case explain your reasons for each major section of the Position Description. Alternatively you can work from an existing Position Description (include a copy with your assignment) and set forth the changes you would make and the reasons for the changes.

 

C.  Assume the NPEA applies to your school and you are school principal. 

    Create an Employment Application for Certified Positions and explain the major provisions of the application. Alternatively you can work from an existing Employment Application for Certified Staff (include a copy with your assignment) and set forth the changes you would made and the reasons for the changes.

If you did not attend the June 15, 2007 Navajo Nation Council Judiciatry Committee meeting on Fundamental law, answer "A." If you did, answer "A" or "B."

A. Assume the Navajo Sovereignty in Education Law applies to your school and you are school principal:

Your School Board will be having a work session on this law. Please prepare a 3-4 page memo to the Board covering these issues:

1.The authority of the Diné Board of Education with respect to your school.

2.The authority of the Diné School Superintendent with respect to your school.

3.What the Board needs to do and not do to avoid getting in trouble with the Diné Board of Education and Diné School Superintendent.

B.  There are sure to be "roadblocks" which will make it difficult to implement the Fundamental Law of the Diné.

Drawing on your experience at the June 15th Judiciary Committee Meeting and the June 16th class discussion (and your knowledge of the Law and the Navajo World), in a 3-4 page memo please discuss some of these roadblocks and your thoughts on how these roadblocks could be overcome.
